NO COST | NO RISK | NO OBLIGATION | FREE COMPENSATION ADVICE

As many as nine out of ten of all car accidents in Australia are a result of driver negligence. Tailgating, speeding, driving without qualification, negligent driving, dangerous driving and reckless driving are all causes of car accidents.

Other causes of car accidents include driver distractions, driver fatigue, drink driving, drunk driving, poor road or weather conditions, poor road design and layout and mechanical failure.

There are three main types of collisions: rear end collision, side collision and head on collision. The rear end collision is the case in which a car from behind crashes into the car in front of it. Usually, the driver from the second car is to blame. A common consequence for rear end collisions is the whiplash, which can be a pretty nasty injury. It can go undetected for a period of even two years, and can have dramatic effects in time. That is why it is extremely important to remember that even if you feel that you have not been injured in a car accident, you should still find out whether you can claim compensation - So find out NOW whether you can claim compensation!

The side collision occurs when a car smashes into one side of the other car. It usually happens in intersections, and the fault is determined by the “the right of way” rule. As for the head-on collisions, these are usually the most devastating and can have dramatic effects. That’s because when two cars hit each other in traffic head on, their speeds combine and the resulting force is much greater. These are the most common accidents which involve death, and usually happen when one car is trying to pass another one without noticing other vehicles coming from the opposite direction.

Tailgating

Tailgating occurs when a motorist drives closer than 1 second behind the vehicle in front of them. This is extremely dangerous seeing as the safe distance between drivers is 2-3 seconds in normal driving conditions. This decreased distance means that if the car in front was forced to make an emergency stop, the tailgater would smash into the rear-end of the leading car, causing a potentially serious car accident.

If you are involved in a car accident and another car hits you from behind, it is almost always the fault of the other driver, irregardless of why the car hit you or stopped in the first place.

Road traffic safety regulations state that a driver must be able to stop safely if another car stops ahead of it. If the driver is unable to stop in time, then the driver was not leaving enough space between their car and the car in front.

If a third car is involved and hits you and you therefore hit the car in front, the driver of the third car is at fault.

In many rear-end road traffic accidents, damage can range from virtually nothing to the total loss of the car. It can be misleading when trying to determine personal injuries of people involved in a car accident.

In a rear-end collision, the impact from the car behind is transferred to the car in front, propelling it forwards until the car stops. The back of the car seat pushes the driver forwards and lifts them up at the same time.

If the driver is not wearing a seat belt, the driver's head may hit the steering wheel, dashboard or windscreen. The force of a rear-end car accident accelerates the rate of a whiplash injury, which can occur in less than one second.

Rear-end car accidents and road conditions have been researched for some time, and wet and rainy conditions can make a car accident more serious and worsen a whiplash personal injury. This is not because the weather makes visibility poor but because a dry road has more grit and friction.

Driver Distractions

It has been proven that using a mobile phone or hand held device is the biggest distraction while driving on the road. Other distractions include time pressures, Distraction caused by passengers, eating and drinking, using the stereo or changing music, in-car technology (such as GPS) and stimulus outside the car.

Driver fatigue

Fatigue causes motorists to be less alert when behind the wheel and essentially contributes to poor driving.

Many of us drive home shattered after a hard day's work or venture on long road trips without taking adequate rest breaks. As a result the roads are full of sleepy drivers who risk causing car accidents which could not only harm themselves but also many innocent people around them. Driver fatigue is up there with drink-driving where dangerous driving is concerned.

Drink driving

Just like driving while tired, driving while under the influence of alcohol can decrease your awareness. It can also slow your reactions, impair your judgement of speeds and distances and lead you to take greater risks, increasing the risk of a car accident.

Technical solutions for preventing drink-driving are becoming widely available and include sobriety detectors. These are locks that prevent the ignition key from working if the driver breathes into one and is shown to have consumed alcohol.

Drug driving

Driving while under the influence of drugs also has a substantial impact on your driving performance. The effects of recreational drugs are those most discussed when drug driving is considered. However, some prescription drugs can be just as dangerous.

Before you take any prescription drugs it is wise to check the instructions that can be found inside the packaging for warnings such as "do not operate heavy machinery", in many instances this also applies to driving.

Mechanical failure and vehicle defects

Around 10% of car accidents on the motorway are a result of mechanical faults and vehicle defects. Such defects with your car may include a tyre blow-out, brake failure and steering mechanism failure. These could result from a manufacturing fault, negligence by a garage worker or just general wear and tear.
